1) Acceptance of these Terms
By using resortandtravel.com you agree to these Terms and our Privacy Policy.
2) Who we are

3) Eligibility & Accounts
Age 16+; keep credentials secure; we may suspend accounts if necessary.
4) Our Intellectual Property & Your Limited License
Content owned by us/licensors; limited personal license; no copying, scraping, or commercial use without
consent.
5) User Content & Submissions
If you submit text, photos, video, audio, ratings, itineraries, or suggestions (“UGC”), you represent you
have the rights to post it and it’s truthful and lawful. You grant us a worldwide, non-exclusive,
royalty-free, sublicensable, transferable license to host, display, modify (for formatting), translate,
distribute, promote, and create derivative works from your UGC in any media now known or later
developed. We may moderate or remove UGC at our discretion and have no obligation to store or return
it.
6) Prohibited Conduct
You agree not to violate any law or third-party rights; copy/scrape/crawl our content; reverse-engineer or
interfere with security; post unlawful or abusive material; upload malware or attempt unauthorized
access; misrepresent identity or operate fake accounts.
7) Third-Party Links, Partners & Bookings
We link to third parties (airlines, hotels, tours, ticketing, insurance, etc.). If you transact off-site, that
relationship is between you and them. We don’t control their pricing, policies, safety, or performance and
aren’t responsible for losses from those services.
8) Affiliate Disclosure & Sponsorships
Some links are affiliate links; we may earn a commission at no extra cost to you. Sponsored content is
labeled. Editorial decisions are independent.
9) User Reviews, Comments & Submissions
UGC terms are as in §5; we may moderate; no obligation to store/return content.
10) Contests, Giveaways & Promotions
Promotions may have additional rules. If those conflict with these Terms, the promotion rules control for
that promotion. You’re responsible for eligibility, taxes, and compliance.
11) Purchases, Subscriptions & Refunds (if offered)
If we sell memberships, reports, or other products: prices may change without notice; taxes/fees are your
responsibility; unless stated otherwise, all sales are final except where required by law; auto-renewing
plans renew at the then-current price until canceled per the plan terms shown at checkout.
12) Intellectual Property; DMCA Policy
All site content is owned by us or our licensors. If you believe content infringes your rights, send a
DMCA notice to privacy@resortandtravel.com with your contact info; the work claimed infringed; the
material’s URL; a statement under penalty of perjury that you’re authorized; and your signature. We may
remove content and terminate repeat infringers.
13) Trademarks
ROY WEBB PRODUCTIONS, RESORT & TRAVEL MAGAZINE, and associated
marks/graphics/trade dress are trademarks or trade dress of their respective owners. Don’t use our marks
without prior written permission.
14) No Advice; Travel Risks
Content is information only—not professional, legal, medical, insurance, immigration, or safety advice.
Travel involves risk (weather, politics, health outbreaks, closures, insolvency, accidents). Verify
requirements (visas, vaccines, entry rules), check official advisories, and make independent decisions.
Use reputable providers and appropriate insurance.
15) AI-Assisted Content
We may use AI tools for research, drafts, or media production. We edit for accuracy, but AI can be
wrong. Verify time-sensitive items (prices, entry rules, schedules).
16) Warranty Disclaimer
THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE
MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR
IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE,
NON-INFRINGEMENT, AND ACCURACY. WE DON’T WARRANT UNINTERRUPTED OR
SECURE OPERATION OR ERROR-FREE CONTENT.
17) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE
DAMAGES; LOST PROFITS, REVENUE, GOODWILL, OR DATA; OR COST OF SUBSTITUTE
SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY
CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED
USD $100.
18) Indemnification
You agree to indemnify and hold us and our affiliates, directors, officers, employees, and agents harmless
from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from
your use of the site, your UGC, or your violation of these Terms or applicable law.
19) Binding Arbitration; Class-Action Waiver; 30-Day Opt-Out
Informal resolution first: email privacy@resortandtravel.com with “Dispute” and a description; we’ll try
to resolve within 30 days. If unresolved, any dispute will be resolved by binding arbitration in West Palm
Beach, Florida, administered by the AAA under its Consumer Arbitration Rules. The FAA governs
enforceability. No class actions—only individual claims. Small claims court in Palm Beach County is
allowed if eligible. You can opt out within 30 days of first accepting these Terms by emailing
privacy@resortandtravel.com stating: “I opt out of arbitration/class-action waiver.”
20) Governing Law; Venue
Florida law governs these Terms (excluding conflict-of-law rules) and the FAA applies to arbitration. For
any permitted court action, state or federal courts in Palm Beach County, Florida have exclusive
jurisdiction and venue.
21) Termination & Suspension
We may suspend or terminate access at any time, with or without notice, for conduct we believe violates
these Terms or harms others. Sections that by their nature should survive (licenses, disclaimers, limits of
liability, arbitration, indemnity) survive termination.
22) Changes to the Site or Terms
We can modify or discontinue features without liability. We may update these Terms; we’ll post the new
effective date. Material changes will be highlighted for a reasonable period. Continued use after changes
means you accept them.
23) International Use; Sanctions
You are responsible for compliance with local laws where you access the site. You represent you are not
located in an embargoed country and are not a prohibited party under U.S. sanctions or export-control
laws.
24) Electronic Communications & Notices
By using the site, you consent to receive notices electronically. We may notify you via the site, email, or
other reasonable methods. Keep your contact details current.
25) Assignment
You may not assign these Terms without our prior written consent. We may assign them in connection
with a merger, acquisition, or asset transfer.
26) Force Majeure
We aren’t liable for delays or failures due to events beyond our reasonable control (disasters, strikes,
outages, war, pandemics, government actions, major provider failures).
27) Entire Agreement; Severability; Waiver
These Terms (plus incorporated policies) are the entire agreement between you and us and supersede
prior communications. If any provision is unenforceable, the remainder remains in effect. Our failure to
enforce a provision is not a waiver of our right to do so later.
